Welcome to Proven Under Pressure. These Terms and Conditions ("Terms") govern your use of our website at provenunderpressure.com, the Uncloud360™ platform at uncloud360.ai, our coaching programs, digital content, and all related offerings operated by Proven Under Pressure LLC ("Company," "we," "us," or "our").
By accessing our website or the Uncloud360 platform, creating an account, or purchasing any product or service, you agree to be bound by these Terms. If you do not agree, please do not use our site or platform.
1. Eligibility
You must be at least 18 years of age to use our services, create an account on the Uncloud360 platform, or purchase from our site. By using our services, you represent and warrant that you meet this requirement.
You agree not to use the website or platform for any unlawful purpose or in any way that could damage our reputation, impair our services, or harm other users.
2. Coaching and Platform Disclaimer
Our coaching, consulting, and Uncloud360 platform services are designed for educational, developmental, personal growth, and adaptive human guidance purposes. We do not offer legal, financial, or medical advice.
Coaching and AI-powered guidance are not substitutes for therapy, psychiatric treatment, medical care, or crisis intervention. Proven Under Pressure LLC is not a covered entity under HIPAA. The Uncloud360 platform is not a healthcare service and does not provide clinical diagnosis or treatment.
If you are experiencing a mental health crisis, please contact the 988 Suicide and Crisis Lifeline (call or text 988), the Crisis Text Line (text HOME to 741741), or your local emergency services. Crisis resources are also accessible within the Uncloud360 platform at any time.
If you require professional mental health services, we encourage you to consult a licensed provider. Uncloud360 is designed to complement, not replace, professional care.
3. The Uncloud360 Platform
Account Creation. To access the Uncloud360 platform, you must create an account and complete the PuP 360 diagnostic assessment. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
AI-Powered Guidance. The Uncloud360 platform uses artificial intelligence to deliver adaptive human guidance based on your assessment results and session history. AI-generated responses are guidance, not professional advice. The quality and relevance of guidance depends in part on the information you provide.
Session Content. Coaching sessions conducted through the Uncloud360 platform are private. Your session content is not shared with third parties except as described in our Privacy Policy. If you access the platform through an employer-sponsored enterprise account, your individual session content is never shared with your employer.
Platform Availability. We make reasonable efforts to maintain platform availability but do not guarantee uninterrupted access. Scheduled maintenance, technical issues, or events beyond our control may result in temporary unavailability.
4. Subscriptions, Payments, and Refunds
Subscription Plans. Uncloud360 is available on a subscription basis with Free, Pro, and Premium tiers, as described on the pricing page. Subscriptions renew automatically on a monthly basis unless cancelled.
Founding Member Rate. Users who subscribe to the Pro plan during the founding member window at the promotional rate of $19 per month will retain that rate for as long as their subscription remains active and uninterrupted. The founding member rate is forfeited upon cancellation and cannot be reinstated.
Billing. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. You are responsible for ensuring your payment information remains current.
Cancellation. You may cancel your subscription at any time from your account settings. Your access will continue through the end of the current billing period. Cancellation does not entitle you to a refund for any portion of the current billing period already paid.
Refunds. Subscription fees are generally non-refundable. If you believe a charge was made in error, please contact us within 14 days at info@provenunderpressure.com and we will review your request.
Individual Coaching and Consulting Services. All payments for individual coaching or consulting engagements must be made in full at the time of purchase unless otherwise agreed in writing. These services are non-refundable due to the time and customization involved.
Rescheduling. Rescheduling requests for booked coaching sessions must be made with at least 24 hours notice. Sessions cancelled with less than 24 hours notice may be forfeited.
Enterprise Accounts. Enterprise accounts are governed by the terms of the applicable contract between Proven Under Pressure LLC and the purchasing organization. Individual enterprise users do not have direct billing relationships with Proven Under Pressure.
5. Intellectual Property
All content on this site and within the Uncloud360 platform — including the PuP 360™ diagnostic framework, the classification system, the behavioral fingerprint methodology, the adaptive guidance prompt architecture, written coaching content, videos, logos, branding, path content, and assessment questions — is the intellectual property of Proven Under Pressure LLC or its licensed partners.
You may not reuse, reproduce, distribute, reverse engineer, or create derivative works from any of our materials or proprietary frameworks without express written consent from Proven Under Pressure LLC.
Your personal assessment results, coaching session content, and reflection responses belong to you. We use this data only as described in our Privacy Policy.
6. User Submissions
If you submit testimonials, reviews, feedback, or questions (e.g., via "Ask Dr. Sam" or similar features), you agree that we may use, display, and share them for promotional or educational purposes, with or without your name, unless you request anonymity. We will never share identifiable personal information from your coaching sessions as a testimonial without your explicit written consent.
7. Acceptable Use
You agree not to:
Attempt to reverse engineer, decompile, or extract the underlying AI prompts, classification logic, or proprietary framework of the Uncloud360 platform
Share your account credentials with others or allow unauthorized users to access your account
Use the platform to collect data about other users or to conduct research without our written consent
Attempt to manipulate the AI system to produce outputs inconsistent with its intended guidance purpose
Submit false or misleading information in the diagnostic assessment or coaching sessions
8. Limitation of Liability
To the fullest extent permitted by law, Proven Under Pressure LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of the site, platform, services, or coaching outcomes, including but not limited to decisions made based on coaching guidance or AI-generated responses.
Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the total amount you paid to us in the three months preceding the claim.
9. Third-Party Links and Services
Our site and platform may include links to or integrations with third-party tools or services such as booking platforms, payment processors, and social media. We are not responsible for the content, accessibility, privacy practices, or terms of these external services. Your use of third-party services is governed by their own terms and policies.
10. Privacy and Data
Your use of our site and platform is governed by our Privacy Policy at provenunderpressure.com/blank. We are committed to protecting your personal information and use it only as outlined in that policy.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Manatee County, Florida, or through binding arbitration as mutually agreed.
12. Modifications to Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our website or platform following a modification constitutes your acceptance of the revised Terms.
